D56 Village Estate Sale
Have you ever cleaned out a closet, the attic or a storage unit and found treasured items that you had forgotten that you had? Or you found that you have multiples of the same item? Well, that’s what happens year over year at Department 56.
Normally we would hold a Sample Sale at our physical offices in Eden Prairie, Minnesota, but because our collectors are scattered far and wide, we opted this year to hold our sale online instead. Our need to declutter is your good fortune!
For the next few months, we will be holding our online Estate Sale to sell through lots of Village houses, cross product, and never-before-seen odds and ends that we feel our collectors will love.
Each auction-style sale will last for one week before a fresh grouping of pieces will launch, so visit often and bid on your favorites!
Terms & Conditions
- The D56 Village Estate Sale is open to collectors in the United States and Canada only. Fresh lots will go live each Monday at 10:00 AM CST and will remain active through the following Monday at 9:00 AM CST. All lots are randomized.
- Some lots will include only buildings, some only accessories, others will contain a mix. Each Estate Sale lot will be numbered and will clearly describe the pieces, item numbers (where available) and years of introduction/retirement therein. Enesco, LLC d/b/a Department 56 has endeavored to accurately describe all items being sold. No licensed items will be sold in the D56 Village Estate Sale.
- All items are sold as is, where is, with all faults. There are no returns, exchanges, replacements, warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. Enesco, LLC shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear, imperfections or aging. Any condition statement, written or verbal, is given as a courtesy to the client, and is only an opinion. It should not be treated as a statement of fact. Written and oral descriptions are statements of opinion and should in no way be construed as a guarantee of any kind as to age, condition, materials or any other feature of items being sold. Enesco, LLC’s goal is to provide prospective bidders with accurate and detailed information.
- Bidders may bid on as many lots as they wish, as often as they wish. All sales are final. Enesco, LLC reserves the right to withdraw any property before the sale.
- Enesco, LLC reserves the right to reject any bids deemed inappropriate. If an item is withdrawn from the auction it will be offered again only at Enesco, LLC’s discretion. Title to all merchandise shall pass to the successful bidder upon close of the applicable auction. The purchaser shall assume full responsibility for the lot purchased once title has passed.
- Payment for all winning bids must be settled within three (3) days of being notified, unless otherwise agreed upon in writing. Payment may be made by bank wire transfer, certified funds, credit card, check or PayPal. Enesco, LLC reserves the right to require payment by bank wire transfer or certified funds. Where permitted by law, a convenience charge of 3.5% will be reflected in the final purchase price for the use of a credit card.
- Enesco, LLC reserves the right to hold all merchandise until receipt of funds is verified.
- All items for this auction are located at Enesco’s office in Eden Prairie, Minnesota. All Estate Sale lots will ship by UPS the week following the close of the auction from Eden Prairie, Minnesota. Under no circumstances will Enesco, LLC be held responsible for items entrusted to a third party shipper. Enesco, LLC will have no liability for any loss or damage to shipped items. The purchase price and all fees must be paid in full before items will be released to the buyer or their agent.
- Internet Bidding: Winning bidders will be notified within three (3) days of the sale. All internet bidders will require registration. Please contact us directly if you have registration questions. Your bid is a contract. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property. Please contact Enesco, LLC to resolve any questions before bidding.
- In bidding on any lot offered, the bidder indicates acceptance of these Terms and Conditions. The bidder is responsible for knowing on which item(s) he or she is bidding. If unsure, the bidder should inquire, or not bid. When becoming the winning bidder at auction, you have affected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. After the item is sold, any loss by fire, theft, breakage, or any other cause is the sole responsibility of the purchaser.
- Enesco LLC reserves the right to accept or reject bids in any increment and all bid amounts will be in its sole discretion.
- All measurements provided on lots are approximate and generally in the order of height by length by width where applicable.
- Unless otherwise noted, the sale of any item at auction does not include a conveyance of any copyright including, but not limited to, reproduction rights and rights of public performance or display.
- Under no circumstance will Enesco, LLC incur liability to a purchaser in excess of the purchase price actually paid. Any claim or controversy arising out of or relating to the auction shall be governed by and construed in accordance with the substantive laws of the State in which the buyer resides, applicable to contracts to be fully performed therein, and without regard to conflict of laws or rules thereof. Any claim or controversy arising out of or relating to the auction shall be submitted to arbitration in the state in which the buyer resides before an arbitrator at an arbitration venue and subject to the rules prevailing at the location of the buyer, as the exclusive remedy for such claim or controversy. By agreeing to arbitrate, the parties waive any right they have to a court or jury trial. The decision of the arbitrator shall be final and binding and may be entered in any court having jurisdiction thereof. The bidder hereby consents to the personal jurisdiction of such courts, agrees to accept services of process by mail and waives any jurisdictional or venue defenses otherwise available to it. The prevailing party shall be entitled to recover the party’s attorneys’ fees and costs incurred in connection with the arbitration.
- Enesco, LLC d/b/a Department 56, nor any of its affiliates are responsible for loss of bid due to power outages, software malfunctions, acts of God, or other unforeseen errors, technical, human or otherwise.
